Stonehill College Guest Residence Hall Usage Terms & Agreement
STONEHILL TERMS & CONDITIONS/RESIDENTIAL POLICIES AGREEMENT
No Refund Policy Narragansett Summer Running Festival Lodging at Stonehill College has a no refund policy. All sales are final. There are no refunds. By making this purchase, you acknowledge you have read and agree to the “No Refund Policy".
Residence Hall Damage Any room or residence hall damages will be assessed and charged at checkout to the credit card which secured the lodging reservation. An additional $30 per lost room key and $30 per residence hall access card will be assessed at checkout.
Residential Agreement/Policies Absolutely no alcohol is permitted in Stonehill College residence halls. Guests are not allowed to bring their own alcohol on the premises of Stonehill College. Each residence hall will be monitored by the Stonehill College Campus Police and Safety Division.
By registering as a Guest in conjunction with the Narragansett Summer Running Festival (hereinafter “the Event”) you agree as follows:
Guest assumes all risk incidental to the use of the College’s space and facilities and shall be solely responsible for any and all loss, accidents or injuries to property or persons (including death) arising out of or in connection with its use. College shall not be liable for any personal injury to Guest’s, or any visitor or invitee of Guest’s, use of the College’s facilities, or for any damage or loss to personal property, including but not limited to that caused by arson, burglary, assault, vandalism, theft or other crimes, or damage attributable to water, smoke, power surges, fire or any other calamity, irrespective of cause. All personal property placed or kept in College’s facilities or on campus shall be at the sole risk of Guest, its participant invitees and staff, and College shall not be liable for any damages or loss to such property.
Guest shall provide adequate and appropriate security and supervision of persons utilizing the facilities, and agrees to defend and indemnify College for any losses, expenses, liabilities or alleged liabilities arising out of or resulting from any failure or alleged failure to provide such security and/or supervision, including, but not limited to, assaults, intentional acts or accident of any kind, nature or degree, on or experienced by any person associated with use of the premises.
Guest agrees to defend, indemnify and hold harmless College, its trustees, officers, employees, representatives and agents (“Indemnified Parties”) from any and all claims, suits, actions, damages and/or costs of any nature resulting from Guest’s use of College’s facilities, including but not limited to damage to property, injuries or death sustained by any person in or about any location within College’s premises, or the violation by Guest or Guest’s agents, visitors or invitees of any law, code, order, ordinance, rule or regulation in connection with the use. The foregoing indemnity shall not be limited in any way by any amount or type of damage, compensation or benefit payable under any applicable workers compensation, disability benefit or other employee benefits act. Guest agrees to waive its right of subrogation against the Indemnified Parties applicable to any claims brought by Guest’s employees or subcontractors.
Guest specifically agrees that this agreement does not create the relationship of landlord and tenant with regard to the use of College-owned property to which this agreement relates. The only relationship intended to be created hereunder is a College/Guest relationship. Guest shall indemnify and hold College harmless against and from all suits, claim, liability, loss and demands against College on the ground that College is a partner, joint venture or employer as a result of this Agreement.
Guest, its personnel, agents and invitees shall at all times be subject to and required to comply with all of College’s policies, rules, regulations and procedures. Each Guest will be supplied at check-in with an official copy of the Stonehill College Conference & Event Services Summer Policies and Code of Conduct Document.
Guest shall make no assignment or sublicense of this Agreement or any of its rights hereunder, except with prior written consent of the College, nor shall Guest suffer or permit the premises to be occupied by others not authorized by College.
Guest understands that the College manages and operates its own academic, athletic and summer programs which help to support its mission and operational objectives. As such, Guest understands that the Event will not be the exclusive user of campus facilities, outdoor roadways and common green spaces, and have entered into this agreement in full cooperation in observing and maintaining the College’s customary safety rules and parking regulations.
It is agreed that the Guest and the Guest’s visitors, agents, or invitees will conduct themselves in a respectable manner and will not cause any nuisance or annoyance. If any College policy is violated, the College, in its sole direction, has the right to request any Guest, agent, visitor, or invitee to vacate the campus without previous notice and the Guest shall be bound to vacate when requested to do so. In such case the College has the right to remove the Guest’s luggage and belongings from the room occupied.
